UH, THE PROJECT BEFORE YOU TONIGHT IS A PROPOSAL TO AMEND THE ZONING ORDINANCE TO IMPLEMENT THE HOUSING ELEMENT OF THE GENERAL PLAN.
UH, THE HOUSING ELEMENT IS ONE OF SEVEN MANDATORY ELEMENTS OF THE GENERAL PLAN, AND IT'S THE ONLY ELEMENT THAT IS REQUIRED TO BE CERTIFIED BY THE STATE DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT OR HCD.
THE HOUSING ELEMENT IS UPDATED EVERY EIGHT YEARS TO DEMONSTRATE HOW THE CITY, HOW THE CITY'S EXISTING AND PROJECTED HOUSING NEED WOULD BE MET.
IN NOVEMBER, 2022, THE CITY COUNCIL APPROVED THE DRAFT HOUSING ELEMENT AND IN JANUARY, 2024, HCD CERTIFIED, THE HOUSING ELEMENT, THERE ARE A NUMBER OF PROGRAMS IN THE HOUSING ELEMENT THAT CITY, UM, MUST IMPLEMENT.
AND THAT'S WHY WE'RE HERE TONIGHT.
SO THE PROPOSED PROJECT IS, UH, CITY INITIATED AMENDMENTS TO THE ZONING ORDINANCE TO IMPLEMENT TWO PROGRAMS IN THE HOUSING ELEMENT.
B 15 REPLACEMENT HOUSING REQUIREMENTS AND D ONE REMOVE DEVELOPMENT CONSTRAINTS.
UH, WE'RE ALSO, UH, PROPOSING SOME MINOR, UH, CLEANUP ITEMS IN THE ZONING ORDINANCE PROGRAM.
B 15 REQUIRES THE CITY TO ADOPT FORMAL REPLACEMENT HOUSING PROGRAM TO ENSURE THAT HOUSING LOSS TO NEW DEVELOPMENT IS REPLACED.
AND PROGRAM D ONE REQUIRES THE CITY TO REVIEW THE ZONING ORDINANCE TO IDENTIFY STANDARDS AND REGULATIONS THAT MIGHT CONSTRAIN DEVELOPMENT OF AFFORDABLE HOUSING.
IN ADDITION, THE PROGRAM UH, REQUIRES THE CITY TO AMEND THE PARKING REQUIREMENTS FOR MULTIFAMILY HOUSING TO REMOVE DISTINCTIONS BETWEEN FOR SALE AND FOR RENT RESIDENTIAL PROJECTS AND TO REMOVE SPECIFIC GUEST PARKING REQUIREMENTS.
SO THE PROPOSED AMENDMENTS FIRST, UM, WE'RE PROPOSING TO ADD A NEW CHAPTER, CHAPTER 8.51 REPLACEMENT HOUSING REQUIREMENTS, UH, THAT SPECIFIES THAT HOUSING DEMOLITION AND NEW HOUSING DEVELOPMENT PROJECTS MUST COMPLY WITH REQUIREMENTS OF STATE LAW GOVERNING REPLACEMENT HOUSING.
IN, UH, CHAPTER 8.76, THE PROPOSED AMENDMENTS WOULD COMBINE FOR SALE AND FOR RENT HOUSING UNDER A NEW MULTI-FAMILY RESIDENTIAL USE TYPE, THEY WOULD ADD PARKING REQUIREMENTS FOR AFFORDABLE HOUSING AND MODIFY THE MINIMUM PARKING REQUIREMENTS FOR MULTIFAMILY HOUSING CONSISTENT WITH THE RECOMMENDATIONS CONTAINED IN A STUDY PREPARED BY W TRANS.
UH, AND THEN A SMALL CHANGE IN CHAPTER 8.08, CHANGING SENIOR CITIZEN APARTMENTS TO SENIOR HOUSING.
THIS TABLE WAS INCLUDED IN YOUR STAFF REPORT AND SHOWS IN UNDERLYING TEXTS WHAT WOULD BE ADDED AND IN STRIKEOUT TEXTS WHAT WOULD BE REMOVED.
SO WE HAVE MULTIFAMILY APARTMENTS AND CONDOMINIUMS. A STUDIO OR ONE BEDROOM WOULD REQUIRE ONE SPACE PER DWELLING, AND TWO PLUS BEDROOMS WOULD REQUIRE TWO SPACES PER DWELLING.
UH, DOWN BELOW YOU CAN SEE, UH, THE SENIOR HOUSING CATEGORY, UH, WOULD HAVE, UH, A REQUIREMENT FOR 0.75 SPACES PER DWELLING.
AND OUR NEW AFFORDABLE HOUSING CATEGORY, UH, STUDIO AND OR ONE BEDROOMS WOULD REQUIRE 0.5 SPACES PER DWELLING AND TWO PLUS BEDROOMS, UH, 1.5 SPACES PER DWELLING.
SOME BACKGROUND ON THE CLEANUP ITEMS. IN FEBRUARY, 2025, THE CITY COUNCIL ADOPTED AMENDMENTS TO THE ZONING ORDINANCE TO PERMIT SINGLE ROOM OCCUPANCY UNITS OR SROS IN THE C TWO ZONING DISTRICT SUBJECT TO A ZONING CLEARANCE.
HOWEVER, UH, STAFF INADVERTENTLY IN PREPARING THE AMENDMENTS USED P PERMITTED INSTEAD OF CC ZONING CLEARANCE IN

THE LAND USE TABLE.SIMILARLY, IN JULY, 2025, THE CITY COUNCIL ADOPTED AMENDMENTS TO THE ZONING ORDINANCE TO PERMIT LOW BARRIER NAVIGATION CENTERS IN THE DOWNTOWN AND PD ZONING DISTRICTS SUBJECT TO A ZONING CLEARANCE.
AND LIKEWISE, STAFF NEGLECTED TO INCLUDE THE CC NOTATION IN THE LAND USE TABLE AND STAFF IS ME
AS PART OF THE ZONING ORDINANCE AMENDMENTS FOR SROS AND LOW BARRIER NAVIGATION CENTERS, AMENDMENTS TO CHAPTER 8.116 WERE INCLUDED AND THAT'S THE ZONING CLEARANCE CHAPTER.
STAFF ADDED SROS AND LOW BARRIER NAVIGATION CENTERS TO ONE OF THE SECTIONS, THE SECTION 8.11, 6.020 APPLICATIONS REQUIR REQUIRING A ZONING CLEARANCE, BUT NEGLECTED TO ADD THE TWO USES TO THREE SUBSEQUENT SECTIONS, APPLICATION APPROVAL AND EXPIRATION OF ZONING CLEARANCE.
SO THE AMENDMENTS BEFORE YOU TONIGHT WOULD CORRECT THE LAND USE TABLE TO INCLUDE THE ZC NOTATION FOR SROS AND LOW BARRIER NAVIGATION CENTERS, AND ADD SROS AND LOW BARRIER NAVIGATION CENTERS TO THE THREE SECTIONS THAT THEY WERE OMITTED FROM.
STAFF'S RECOMMENDATION TONIGHT IS TO CONDUCT A PUBLIC HEARING, DELIBERATE AND ADOPT THE RESOLUTION RECOMMENDING CITY COUNCIL APPROVAL OF AMENDMENTS TO DUBLIN MUNICIPAL CODE CHAPTER 8.08, CHAPTER 8.12, CHAPTER 8.76, AND CHAPTER 8.116 AND THE ADDITION OF CHAPTER 8.51.

UM, WE ARE SCHEDULED TO GO BACK TO THE CITY COUNCIL ON MARCH 3RD TO REQUEST AN EXTENSION OF THAT URGENT INTERIM ORDINANCE.
UM, ALSO AT THE FEBRUARY 3RD, UM, CITY COUNCIL, UM, DIRECTED STAFF TO BRING FORWARD PROPOSED AMENDMENTS ON THE CITY NOISE ORDINANCE.
